Sexual Harassment by Employees of the Same Sex

When most people envision sexual harassment, they picture a harasser and victim of the opposite sex—typically a male harasser and female victim. Ohio employees should know, however, that the employment discrimination laws also protect them from sexual harassment by someone of the same sex. [Read more…]

Yet Another NFL Cheerleader Minimum Wage Class Action Lawsuit!

Share Button

Two months ago, I blogged about an Ohio minimum wage class action lawsuit filed against the Cincinnati Bengals by one of the team’s former cheerleaders. I predicted we might soon see more class action lawsuits filed by other professional cheerleaders because “similar minimum wage and overtime class actions tend to come in bunches.” Well maybe I should buy a lottery ticket, because my prediction came true. Bill to Protect Victims of Workplace Sexual Assault Offered in Ohio House

Share Button

A much-needed Bill to protect victims of workplace rape and sexual assault was recently introduced in the Ohio House of Representatives. The Bill would remove an arbitrary and discriminatory limit on damages and allow victims to receive a fair recovery for their injuries. All Ohioans who care about the rights of victims of sexual violence and sexual harassment, or our civil jury system, should support the Bill. [Read more…]

What Employment Rights do I Have in an Office Romance?

Share Button

Valentine’s Day is coming and love is in the air—or is it the flu? It’s probably a little bit of both. But for now, let’s assume it’s love. When love finds its way into the workplace, there are several employment law issues about which Cleveland area employees should be aware. [Read more…]

EEOC Settles Ohio Sex Discrimination Class Action Suit against JPMorgan

The U.S. Equal Employment Opportunity Commission announced this week that JPMorgan Chase has agreed to pay $1,450,000 to settle a sex discrimination class action lawsuit. Although the case arises out of JPMorgan’s Columbus, Ohio office, the lessons it offers apply just as much to employees in Cleveland, and elsewhere in Ohio. [Read more…]

Case Western Retaliation Lawsuit Heats Up

Share Button

Last month we wrote about a very interesting employment retaliation lawsuit filed in Cleveland by a Case Western Reserve University law professor against the school and its Dean.  (We are not involved in the lawsuit). The lawsuit accuses Dean Larry Mitchell of sexually harassing multiple female members of the Case Western Law School community, and then illegally retaliating against the plaintiff, Professor Raymond Ku, for reporting the alleged sexual harassment. Since it was filed just late last month, two extraordinarily unusual things have happened in the lawsuit.

Should I Report Being Sexually Harassed at Work? (Yes!)

Share Button

Sexual assault is one of the most underreported crimes. While exact figures are hard to quantify, a 2005 U.S. Department of Justice study found that about 60% of sexual assaults go unreported. Workplace sexual harassment is vastly underreported as well. An August 2013 poll by Huffington Post/YouGov found that nearly one-third of all employees (yes, men as well as women) say they have been sexually harassed at work by a boss or co-worker. Yet a full 70% of the victims did not report it. [Read more…]

Lessons about Sexual Harassment from the Ariel Castro Case

Share Button

As expected, a Judge on the Cuyahoga County Court of Common Pleas sentenced Ariel Castro to life in prison this week. It’s likely the last we’ll hear from Castro ever again. Most of us will soon relegate him and his horrible crimes to the recesses of our minds. But his victims won’t. For the rest of their lives, they will cope with the emotional scars left by his decade of sexual assault and psychological torture. [Read more…]

Care for Some Coffee with Your Sexual Harassment?

Share Button

If you asked people to name the types of workplaces where they would expect to find sexual harassment, not too many would list “coffee shop.” Most would probably list a factory or other blue-collar workplace. This week’s news reinforces that sexual harassment is in fact found in unexpected places. [Read more…]

Sexual Harassment and Retaliation at Dunder Mifflin

If you watch NBC’s The Office, it should come as no surprise that the antics at Dunder Mifflin often bump up against the workplace employment laws. This week’s episode provides an example of how workplace romance can lead to a sexual harassment or retaliation claim. [Read more…]
